Can a spouse file a joint Form 8892?

No! Form 8892 can only be filed by an individual taxpayer and cannot be used for joint filings. If both spouses need to file Form 8892, each must complete a separate form and mail it in separate envelopes to the IRS.

What is the difference between Form 8892 and Form 8892-V?

Form 8892 is the full extension application, including Parts I, II, and III. Form 8892-V is the payment voucher (Part III) used specifically to submit a gift or GST tax payment.

If you only need to make a gift tax payment and are not requesting a new extension, only Part III needs to be completed.

When is Form 8892 due, and when can I start filing?

Form 8892 must be filed by the regular due date of Form 709 or 709-NA, generally April 15. Once granted, the extension runs until October 15 of the applicable year.

If the due date falls on a Saturday, Sunday, or legal holiday, the next business day is the deadline.

What are the penalties for not filing Form 8892 on time?

Missing the April 15 deadline can result in two separate IRS penalties:

  • Late Filing Penalty: 5% of unpaid tax for each month your return is late — up to a maximum of 25%.
  • Late Payment Penalty: ½ of 1% of the unpaid tax for each month the tax remains unpaid — up to a maximum
    of 25%.
  • Interest: Charged on top of any unpaid tax from April 15 until the full amount is paid. Interest accrues regardless of the reason for
    late payment.
