What is the ERISA Form 5500?
The Form 5500, Annual Return/Report of Employee Benefit Plan, is used to about the company’s employee benefit plans. It includes details such as the investments, operations, and conditions of the plan. Any administrator or sponsor of an employee benefit plan subject to ERISA must file information about each benefit plan every year.
The Internal Revenue Service (IRS), Department of Labor (DOL), and Pension Benefit Guaranty Corporation (PBGC) have consolidated certain returns and report forms to reduce the filing burden for plan administrators and employers. Employers and administrators who comply with the instructions for the Form 5500 generally will satisfy the annual reporting requirements for the IRS and DOL.
Who Needs to File Form 5500?
The employer maintaining the plan or the plan administrator of a Pension or Welfare benefit plan covered by ERISA must generally file the Form 5500 to report information concerning the qualification of the plan, its financial condition, investments and the operations of the plan.
The following plans require their sponsors to file a separate Form 5500:
- 401(k) plans
- Annuity arrangements
- Medical, dental, and life insurance
- Pension plans
- Money purchase, profit sharing, and stock bonus plans
- Severance pay plans
- Retirement arrangements
Where to File Form 5500?
You must file Form 5500 electronically through EFAST2. And you can also file Form 5500 through approved EFAST Software Vendors.
When is Form 5500 Due?
Plan sponsors generally must file their Form 5500 by the last day of the seventh month following the end of the plan year.
For example, a plan year that ends December 31st should have its Form 5500 filed by July 31 of the following year to avoid late fees and penalties.
Can I File Extension for Form 5500?
A plan may obtain a one-time extension of time to file a Form 5500 Annual Return/Report up to 2½ months by filing IRS Form 5558, Application for Extension of Time To File Certain Employee Plan Returns, on or before the normal due date of the return/report.
