A Reporting Agent can be an individual or an entity authorized by a taxpayer to prepare and file their withholding tax returns (941, 940, 943, 944, 945, & 1042) with the IRS.
What things a reporting agent could be responsible for?
The Reporting Agents could also be responsible to:
- Make deposits and payments with certain tax returns listed in Form 8655.
- Respond to specific IRS notices relating to Form W-2, 1099, 3921 and 3922.
- Receive duplicate copies of tax information and other communication from the IRS.
How to Get Authorization From Your Client?
To be a reporting agent, you should get authorization through Form 8655 from each client who needs you to file their return on their behalf.
How does a Reporting Agent sign a return?
Reporting Agents sign all of the electronic returns they file with a 5-digit PIN signature. If your application is approved, the IRS will assign you a Reporting Agent PIN.
How do Reporting Agents apply for an RA PIN?
Here are the steps to apply for an RA PIN:
- Have each client complete and sign a Form 8655.
- Complete a “Reporting Agent’s List.”
- Send the Form 8655 along with a “Reporting Agent’s List” to the IRS
The IRS will review your application and verify the information provided. Upon approval, you will be authorized as a reporting agent and provided with a
5-digit PIN.
What is the New IRS filing requirement for reporting agents?
The new 2024 requirements that impact Reporting Agents are as follows:
- Yes, the IRS mandates that Reporting Agents e-file the 94x Series and certain other forms they handle, with the only exception being if there are no e-filing options available for the form.
- Starting in tax year 2023, previous Form 940-PR filers will now use Form 940. Additionally, they will have the choice to file the new Spanish language Form 940 (sp).
- Starting with the first quarter of 2024, previous Form 941-SS filers will transition to filing Form 941, tailored for their use in the revised version issued for this quarter.
What if you get a Power of Attorney or Tax Information Authorization ?
For authorization purposes, you may also use any of the following forms in addition to or apart from 8655.
- Form 2848, Power of Attorney, and Declaration of Representative - Authorize you as an individual to represent before the IRS.
- Form 8821, Tax Information Authorization - Authorize you as an individual to inspect confidential tax return information related to the bond issuance.
Note: The authority granted on Form 8655 will not revoke any Power of Attorney (Form 2848) or Tax Information Authorization (Form 8821) in effect.
